There is a PENDING court case and several motions for judgements and fines against the property do to the current violations however there are NO current judgements or fines placed on the property to date.

STATEMENT FROM THE COLORADO WATER QUALITY CONTROL DIVISION

The Division issues a Notice of Violation in response to inspections of a project/property that document violations of the Water Quality Control Act and/or a Permit. If the violations identified during an inspection aren't fixed, the Division will issue an NOV. In response to the NOV, the entity is required to complete corrective actions. Once the corrective actions are completed, the Division will typically assess a civil penalty. The civil penalty period is ongoing until the corrective actions are completed. That being said, the Notice of Violation from November 6th was issued to Homesteader Development so any civil penalties resulting from it would be assessed to them. any liability for current civil penalties is with the current owner and permittee.

The new owner will be responsible for obtaining stormwater permit coverage for the property through a new permit or transfer of the current permit. They will then be responsible for meeting the requirements of that permit. I am happy to work with them on that process. There are significant stormwater issues at the property that will need to be addressed quickly by the new owner. However, those issues would not result in a Notice of Violation or civil penalties for the new owner unless they were negligent in correcting the issues at the property.

Bidders Registration:All prospective buyers must register to bid. An initial deposit of $20,000 in the form of a cashier’s check or wire transfer payable to Prestige Real Estate Auction will be required to bid at the auction along with a signed Terms and Conditions,

Property Information Package Receipt and Bidder Registration Card and Initial Bid Form. The $20,000 deposit will be immediately returned in the event the bidder is unsuccessful. (Please call for wire instructions). Registration must be completed 48 hours prior to the auction.

Initial Bid: To register you are required to submit an initial bid. Once prospective buyers place initial bids and the auction company formally commences the auction, each initial bid is binding on the respective prospective buyer.

Buyer’s Premium:A 10% Buyer’s Premium will be added to final bid and included in total Contract Price.Earnest Money Deposit:10% non-refundable earnest money deposit will be due immediately after being declared the winning-bidder. The remainder of the earnest money deposit (above the initial deposit) can be paid by check or wire transfer. Wire transfers must post within 24 hours after being declared the winning-bidder. This amount will be applied to the purchase price and will be deposited in the brokers escrow account.

Purchase Contract: Winning-bidder hereby agrees to enter into an Auction Buy/Sell Contract to Purchase the property immediately upon being declared the Winning-Bidder by the Auctioneer.
